REFUND POLICY

1. General provisions

This Refund Policy (the “Policy”) governs the procedure and conditions for refunding funds to clients of PE Lutsiak Y.V. (the “Provider”) who paid for services via the LiqPay payment service. The Policy has been developed in accordance with the Law of Ukraine “On Protection of Consumer Rights”, the Civil Code of Ukraine, and the rules of the Visa and Mastercard international payment systems.

2. Nature of the Provider’s services

The Provider supplies information, consulting and organisational services for sourcing, purchasing at foreign auctions, delivery, customs clearance and (subject to the parties’ agreement) repair of vehicles from Europe, Korea and the USA. The services are complex and rendered in stages. The procedure for providing services and settlements is detailed in the Service Agreement signed with each client individually.

3. Payment methods

Payment is processed via LiqPay (JSC CB “PrivatBank”) using Visa, Mastercard, Apple Pay, Google Pay, PrivatPay and other available methods. All payments are made in Ukrainian hryvnia (UAH).

4. Refund conditions

A refund is possible in the following cases:

The service was not provided due to the Provider’s fault.

The client was not recognised as the winner of the auction for the selected lot — in this case the deposit is refunded in full within the period set in the Agreement (usually within 3-30 days).

The client cancelled the service before its commencement — provided the stage has not yet started and after deduction of the Provider’s documented expenses.

Erroneous payment (double charge, technical error of the payment system).

Other cases provided for by the current legislation of Ukraine and the executed Agreement.

5. Cases where no refund is issued

A refund will NOT be issued in the following cases:

The client was recognised as the auction winner but refused to pay for the purchased lot — in this case the deposit is forfeited to the Provider to cover the auction organiser’s penalties, as set in the Agreement.

The service has already been provided (in whole or in part) — a refund is possible only for the part of the services actually not rendered.

The client cancels the service after the vehicle has been purchased at the auction.

Expenses incurred by the Provider as part of order fulfilment (auction fees, logistics, customs duties, insurance, etc.) are non-refundable as they have been paid to third parties.

In the event of force majeure preventing performance, a refund is issued only for the unused portion.

6. Refund procedure

The client submits a written refund request by email to [email protected] or notifies the Provider by phone at 0 800 330 204 and subsequently provides the written request.

The request must include: full name, contact details, date and amount of payment, order number (if any), reason for the refund, and refund details (as a rule, refunds are issued to the same bank card from which the payment was made).

The Provider reviews the request within 10 (ten) business days of its receipt.

If approved, the refund is processed via LiqPay to the same bank card used for payment.

Crediting times depend on the issuing bank and usually take from 1 to 14 banking days.

7. Fees and expenses

When refunding via LiqPay, the payment system fee retained at the time of the original payment is not refundable (in accordance with the rules of Visa, Mastercard and LiqPay). Bank fees and international transfer fees (SWIFT) are also non-refundable.

8. Disputes

In the event of a dispute, the parties shall make efforts to resolve it through negotiations. If no agreement is reached, the dispute is settled in court under the laws of Ukraine. The client also has the right to file a chargeback request with the bank that issued their payment card under the Visa/Mastercard rules.
